1. Introduction
Nest Family Chiropractic PLLC ("Nest Family Chiropractic," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect through our website at https://www.nestfamilychiro.com, our social media accounts, and our email and text communications, how we use and share it, and the choices you have.
By using the Site, you agree to this Privacy Policy. If you do not agree, please do not use the Site.
2. Website Information vs. Patient Health Information
This Privacy Policy covers information collected through the Site and our marketing channels. It does not govern the health information we create or receive when you are a patient of our practice.
If you become a patient, your protected health information ("PHI") is handled under the Health Insurance Portability and Accountability Act (HIPAA), the Minnesota Health Records Act, and our Notice of Privacy Practices, which you will receive at or before your first visit.
If this Privacy Policy and our Notice of Privacy Practices ever conflict regarding your PHI, the Notice of Privacy Practices controls.
Please do not send health details or other sensitive information through our general contact form, regular email, social media messages, or text messages. These channels may not be secure. Use our secure online scheduling portal on Acuity or call us instead.
3. Information We Collect
Information you give us
• Contact and inquiry information: your name, email address, phone number, and the message you send when you use a contact form or reach out to us.
• Appointment scheduling information: your name, contact details, and appointment preferences when you book through our scheduling platform, Acuity Scheduling. Information you enter to schedule or complete intake forms may be PHI once you are a patient.
• Email list information: your name and email address if you subscribe to our newsletter or updates.
• Payment information: if you pay online, payment is handled by our payment processor, Stripe. We do not store full payment card numbers on the Site.
Information collected automatically
When you visit the Site, we and our service providers may automatically collect:
• Your IP address, browser type, device type, and operating system
• Pages viewed, links clicked, time spent on pages, and the website you came from
• Approximate location based on your IP address
This information is collected through cookies and similar technologies (see Section 6).
Information from third parties
If you interact with us on social media (for example, Instagram), we receive the information that platform makes available to us, such as your username and any message or comment you send.
4. How We Use Your Information
We use the information we collect to:
• Respond to your questions and requests
• Schedule and manage appointments
• Send appointment reminders, confirmations, and practice updates

5. How We Share Your Information
We do not sell your personal information. We do not share it for third-party advertising purposes.

• Service providers who help us run the practice and the Site, such as website hosting, scheduling, email marketing, texting and phone, payment processing, and IT support. These providers may use your information only to provide services to us. Where a provider handles PHI, we have a business associate agreement with them as HIPAA requires.
• Legal and safety recipients when we believe disclosure is required by law, subpoena, or court order, or is necessary to protect the rights, safety, or property of our patients, our practice, or others.
• A successor if our practice is sold, merged, or transferred, in which case the information would remain subject to this Policy and applicable health privacy laws.
• Others with your consent or at your direction.
6. Cookies and Analytics
Cookies are small files placed on your device. We use them to keep the Site working, remember preferences, and understand how the Site is used.
Our website platform provides basic analytics. We use Google Analytics via Squarespace. We do not use advertising pixels or tracking tools that send your browsing activity to advertising networks.
You can control cookies through your browser settings. Blocking some cookies may affect how the Site works. Some browsers also support "Do Not Track" or Global Privacy Control signals; [we honor Global Privacy Control signals where technically feasible].
7. Email and Text Messages
Email. If you subscribe to our emails, you can unsubscribe at any time by clicking the "unsubscribe" link in any message or contacting us.
Text messages. If you give us your mobile number and agree to receive texts, we may send appointment reminders, scheduling messages, and practice updates. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Consent to receive texts is not a condition of receiving care. Text messages are not a secure way to share health information, so please keep texts to scheduling and logistics. We do not share mobile numbers or text-messaging opt-in data with third parties for their marketing purposes.
8. Social Media
We maintain accounts on platforms such as Instagram. When you interact with our social media pages, the platform's own privacy policy applies to the information it collects. We are not responsible for the privacy practices of social media companies. Please avoid sharing health information in comments or direct messages.
9. Data Security
We use reasonable administrative, technical, and physical safeguards to protect information we collect. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If we are required to notify you of a breach affecting your information, we will do so as the law requires.
10. Data Retention
We keep website and marketing information only as long as needed for the purposes described in this Policy, unless a longer period is required by law. Patient records are retained according to Minnesota and federal requirements and our Notice of Privacy Practices.
11. Your Choices and Rights
• Email and text: opt out any time as described in Section 7.
• Access, correction, or deletion: you may contact us to ask what website or marketing information we hold about you, to correct it, or to request deletion, subject to legal exceptions. Requests about your patient records are handled under HIPAA and the Minnesota Health Records Act; please contact us at the address below and we will direct your request appropriately.
• Cookies: manage them through your browser settings.
Depending on where you live, you may have additional privacy rights under state law.
12. Children's Privacy
Our practice cares for children and infants, but the Site is intended for parents, guardians, and other adults. We do not knowingly collect personal information directly from children under 13 through the Site. If you believe a child has submitted information to us, please contact us and we will delete it. Parents and guardians may provide information about their children to schedule care.
13. Third-Party Links and Services
The Site may link to third-party websites and services, including our scheduling platform and social media accounts. We do not control those sites and are not responsible for their content or privacy practices. Please review their policies.
14. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on the Site and change the effective date above. Continued use of the Site after changes means you accept the updated Policy.

1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the website at https://www.nestfamilychiro.com (the "Site") and related online services operated by Nest Family Chiropractic PLLC ("Nest Family Chiropractic," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
These Terms apply to the Site only. Care you receive at our office is governed by the patient agreements, consent forms, and policies you review and sign as a patient.
2. No Medical Advice and No Doctor-Patient Relationship
The content on the Site, including blog posts, social media content, videos, and resources, is for general educational and informational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for professional care from a qualified provider who knows your individual circumstances.
Using the Site, sending us a message, booking an appointment request, or following our social media accounts does not create a doctor-patient relationship. That relationship begins only when we have agreed to provide care and you have completed our intake and consent process.
Do not delay or disregard professional medical advice because of something you read on the Site. This is especially important for pregnant patients, infants, and children.
If you think you or your child is having a medical emergency, call 911 or go to the nearest emergency room. Do not use the Site or send us a message in an emergency.
3. Results Vary
Chiropractic care affects each person differently. Any testimonials, reviews, or examples on the Site reflect individual experiences and are not a guarantee, promise, or prediction of results for you or anyone else.
4. Appointments and Scheduling
You may request or book appointments through our online scheduling platform, Acuity Scheduling. Booking an appointment online does not guarantee that chiropractic care is appropriate for you; we may reschedule, decline, or refer you elsewhere based on our clinical judgment. The scheduling platform is operated by a third party and has its own terms and privacy policy. Please give accurate and complete information when you book.
5. Acceptable Use
You agree not to:
• Use the Site for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or someone else's information
• Try to gain unauthorized access to the Site, our systems, or other users' information
• Introduce viruses, malware, or other harmful code
• Interfere with or disrupt the Site or its security

11. Limitation of Liability
To the fullest extent permitted by law, Nest Family Chiropractic PLLC and its member, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Site, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Site is limited to $100 or the maximum amount permitted by law, whichever is greater.

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought in the state or federal courts located in Dakota County, Minnesota, and you consent to their jurisdiction.

16. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding use of the Site.
